NZCS today sent a letter to Hon Simon Power, Minister of Commerce, in support of the removal of patentability of software in the Patents Act.
The Society acknowledges this is a complex issue with many reasons for and against patentability of software. However on balance, it is in New Zealand's best interests for software to be covered through the provisions of copyright in the same way movies and books are, rather than through the patent system which has significant problems.
We also appreciate there is a divergence of views in the sector, however we believe this step is widely supported. For example, a quick poll of members shows around 97% support for NZCS taking a stand, and approximately 80% in favour of us supporting the Commerce Select Committee's recommendation that software patents be removed.
